On September 1, 2022, the U.S. District Court for the Northern District of California in Behring Regional Center LLC and IIUSA v. Mayorkas, et al., 3:22-cv-2487, and EB5 Capital, et al. v. Dept. of Homeland Security, et al., 3:22-cv-3948, approved a settlement between the parties. Under the terms of the settlement, representatives of USCIS must participate in quarterly meetings with representatives of the plaintiffs to discuss implementation of the settlement. In accordance with the transparency provisions of Sec. 107 of the EB-5 Reform and Integrity Act of 2022, USCIS will make minutes of these meetings publicly available through publication on the USCIS website.
