DHS Secretary Designates Haiti for TPS
July 30, 2021
Secretary of Homeland Security Alejandro N. Mayorkas designated Haiti for Temporary Protected Status (TPS) for 18 months, effective August 3, 2021, through February 3, 2023. Haitian nationals and individuals having no nationality who last habitually resided in Haiti may submit an initial registration application under the TPS designation for Haiti and apply for an Employment Authorization Document (EAD) during the 18-month registration period that begins August 3, 2021 and ends on February 3, 2023. The EADs of TPS beneficiaries have a Category Code of A12 or C19.
U.S. District Court for the Southern District of Texas Decision on Deferred Action for Childhood Arrivals (DACA)
July 21, 2021
USCIS is complying with the July 16th order from the U.S. District Court in Texas. Deferred Action for Childhood Arrivals (DACA) recipients with a valid Employment Authorization Document (EAD), including an EAD that has been automatically extended, are still permitted to work. See I-9 Central for more information on Completing Form I-9 for Employees with Extended Work Authorization Under DACA.
TPS for Somalia Extended and Somalia Redesignated for TPS for 18 Months; EADs Automatically Extended Through March 16, 2022

Secretary of Homeland Security Alejandro N. Mayorkas extended Temporary Protected Status (TPS) for Somalia and redesignated Somalia for TPS through March 17, 2023. Current beneficiaries who want to maintain their status must re-register July 22, 2021 through September 20, 2021. Somali nationals and individuals having no nationality who last habitually resided in Somalia may submit an initial registration application under the redesignation of Somalia for TPS and apply for an EAD.
Reminder – Employer Action Required on Tentative Nonconfirmations within 10 Federal Government Working Days

E-Verify requires all employers to take action on Tentative Nonconfirmation cases (TNC) for their employees within 10 federal government working days. Although most Social Security Administration offices are currently closed, this does not affect the 10-day requirement. Employers are reminded to complete the following steps in E-Verify within 10 federal government working days after issuance of a TNC result:
E-Verify Web Services Listening Session for ICA v31 Draft Release

U.S. Citizenship and Immigration Services (USCIS) invites you to participate in an E-Verify Web Services (WS) Listening Session for the Interface Control Agreement (ICA) version 31 (v31) Draft Release on July 28 from 2 – 3:30 p.m. Eastern. The listening session will provide an opportunity for WS developers to ask questions, share concerns and provide valuable feedback on their experiences with the new ICA v31 draft release. Your feedback may be integrated into the final ICA v31 public release scheduled in September.
Update: M-274, Section 6.3 Refugees and Asylees

We have updated Section 6.3 of the M-274 for refugees and asylees. There are now several sentences reminding employers that asylees and refugees may present any acceptable documents in their possession. Please see UPDATE: M-274, Section 6.3 Refugees and Asylees.
TPS for Yemen Re-Designated and Extended for 18 Months; EADs Automatically Extended Through March 2, 2022

Secretary of Homeland Security Alejandro N. Mayorkas extended and re-designated Temporary Protected Status (TPS) for Yemen for 18 months, from Sept. 4, 2021, through March 3, 2023. Current beneficiaries who want to maintain their status must re-register July 9, 2021 through Sept. 7, 2021. Yemeni nationals and individuals having no nationality who last habitually resided in Yemen may submit an initial registration application under the re-designation for TPS for Yemen and apply for an Employment Authorization Document (EAD) between July 9, 2021 and March 3, 2023.

We are sending this reminder based on inquiries from the public. An employee that is a Permanent Resident may provide a Form I-797, Notice of Action with their expired Permanent Resident Card (PRC) for Form I-9.
